Terms of Service

1. Applicability

1.1 These Terms of Service (“Terms” / “AGB”) apply to all photography services, bookings, offers, and contracts between Devora Stachel (the “Photographer”) and the client (“Client”), unless otherwise agreed in writing.

1.2 By booking a service, signing a contract, paying a retainer, or otherwise engaging the Photographer, the Client agrees to these Terms.

1.3 Deviating general terms of the Client are not recognized unless expressly agreed in writing.

2. Services & Booking

2.1 The Photographer offers portrait, couples, family, and other personalized photoshoot services as described on the website.

2.2 Booking a service requires confirmation by the Photographer and receipt of a non‑refundable retainer payment (e.g., a percentage of the total fee).

2.3 Full payment of the remaining balance is due before or on the date of the photoshoot, unless otherwise agreed.

3. Fees & Payment

3.1 All prices are stated in Euro (€). No additional taxes or VAT are applied.

3.2 Payments must be made by bank transfer. The payment details will be provided upon booking.

3.3 Invoices that are not paid on time may incur late fees or interest.

4. Copyright & Usage Rights

4.1 The Photographer retains all copyrights and related rights to all images and materials created (§§1,2,73ff Austrian Copyright Act / UrhG).

4.2 Upon full payment, the Client obtains a limited, non‑exclusive, non‑transferable usage license for the agreed purposes (e.g., personal use, online sharing, prints). Use beyond the agreed terms requires written permission.

4.3 The Client may not sell, redistribute, modify, or commercially exploit the images without written approval.

5. Delivery

5.1 The Photographer will deliver final images within the timeframe outlined in the booking agreement.

5.2 The Photographer is not responsible for delays due to events outside their control (weather, illness, etc.).

6. Model Consent & Privacy

6.1 The Client is responsible for obtaining consent from any person who appears in the photos (minors, models, etc.) if required.

6.2 The Photographer may use delivered images for self‑promotion (portfolio, website, social media) unless a written restriction is agreed.

6.3 Data processing and privacy practices are governed by the Privacy Policy on the website.

7. Cancellation & Rescheduling

7.1 The retainer is non‑refundable.

7.2 Cancellations within a short period before the photoshoot (e.g., 72 hours) may be charged a cancellation fee.

7.3 Rescheduling is subject to availability.

8. Liability

8.1 The Photographer’s liability for damage is limited to direct damage caused by gross negligence or intent.

8.2 Liability for indirect damages (lost earnings, consequential loss, etc.) is excluded.

9. Governing Law

9.1 These Terms are governed by Austrian law.

9.2 Place of jurisdiction is Vienna, Austria.
